PLUGINMARKET.IO

Terms of Service

Effective date: 2026-09-17

Last updated: 4 Nov 2026

These Terms of Service ("Terms") govern your use of pluginmaker.ai, operated by PLUGINMAKER.AI sp. z o.o. (Os. Piastowskie 94/26, 61-162 Poznań, Poland; KRS 0001238740, NIP 7822969104, REGON 544622536 — "we", "us"). By creating an account or using the platform you accept these Terms. If you do not agree, do not use the platform.

If you are a consumer in the EU, nothing in these Terms removes the mandatory protections of your country of habitual residence (see §15). For consumers in Poland, the Polish-language Regulamin is the binding version.

1. Who we are & what this covers

pluginmaker.ai is an online service that turns a text description into an audio plugin: our AI generates the DSP and interface, and our pipeline compiles it. These Terms apply to User accounts on pluginmaker.ai. Customers of our enterprise partners' white-label apps ("Brand End-Users") are covered by separate terms shown in that branded app, not here.

2. The service is AI-generated

Plugins are produced by automated AI systems. Output varies, may contain errors, and is not guaranteed to be fit for any particular purpose. You are responsible for testing a plugin before relying on it. This disclaimer is subject to the mandatory consumer rights in §13.

3. Your account & acceptance

You need an account to use the service, and you must be at least 18 or the age of majority where you live. You are responsible for keeping your credentials secure. By creating an account you confirm you accept these Terms and our Privacy Policy; we record which version you accepted and when. If we make material changes, we will ask you to accept the new version before you continue; minor changes take effect when posted.

4. Acceptable use

You agree not to:

  • use the service for any unlawful purpose;
  • generate, upload, or distribute unlawful, infringing, or harmful content;
  • extract, reverse-engineer, or redistribute our underlying technology (see §6), except to the extent expressly permitted by an applicable third-party licence;
  • impersonate other users or entities.

You are responsible for the prompts you submit and for ensuring your use does not infringe anyone's rights.

5. Plans & entitlements

  • Free: generate plugins and preview them in your browser, subject to your available credits.
  • Building and downloading native, installable plugins (VST3 / AU) — the files you load into your DAW — is a paid feature and is not available on the free tier. It requires a paid plan.
  • Enterprise / white-label is a separate, individually arranged offering (see §10).

6. Plugins you generate — your licence & our technology

6.1 Your use

Subject to these Terms and your paying for the relevant entitlement, you receive a personal, worldwide licence to use the plugins you generate in your own music and productions.

6.2 Ownership and our technology

The plugins generated for you — including their DSP code, user interface and presets — and all intellectual property in them are owned by us (or our licensors), excluding any prompts, audio samples or other materials you provide, which remain yours. You receive only the licence described in §6.1; no ownership of the generated plugin is transferred to you. A plugin you buy in the Marketplace (section 11) is likewise licensed to you, not sold to you: you get the licence described in section 11 and no ownership.

Generated plugins also incorporate and link our proprietary runtime library, which remains our intellectual property. You may not extract, isolate, reverse-engineer, sublicense, or redistribute a generated plugin's source or that library.

Some plugins also include third-party software governed by separate open-source or other licences. Those licences continue to apply to the components they cover, and nothing in these Terms limits rights they expressly grant you. The corresponding notices and licence texts are included with the applicable plugin or installer.

6.3 No commercial resale without consent

You may sell a plugin you generated through the Marketplace (section 11) by accepting the creator agreement in §11.1. That agreement is the separate commercial agreement this section asks for, and it covers sales in the Marketplace only.

Your licence is for your own use. Commercially reselling, redistributing, sublicensing, or otherwise making generated plugins available to third parties falls outside this licence and requires our prior written consent under a separate commercial agreement. If you want to sell or distribute plugins commercially, contact us at office@pluginmaker.ai to arrange enterprise terms, which are negotiated individually.

7. Credits

Generation consumes credits. Signup credits and purchased top-up credits do not expire. Subscription credits refresh at the start of each billing period and do not roll over — any unused subscription credits are forfeited at the end of the period or on cancellation. Credits have no cash value and are not redeemable for money except where required by law (see §9).

8. Subscriptions, payments & invoicing

Paid plans are billed through Stripe and renew automatically at the end of each billing period until you cancel. You can cancel anytime from your account settings; cancellation takes effect at the end of the current billing period, and you keep access (and any remaining subscription credits) until then. We will give reasonable advance notice of any price change. Prices are shown inclusive or exclusive of VAT as indicated at checkout; we issue invoices in accordance with Polish law (including, where applicable, e-invoicing via KSeF). We do not store card details — payments are processed by Stripe.

9. Right of withdrawal (EU consumers)

As an EU consumer buying online you normally have 14 days to withdraw from a purchase. For digital content supplied immediately (the generated plugins and native builds), at checkout we ask you to (a) expressly consent to immediate performance and (b) acknowledge that you thereby lose your 14-day right of withdrawal, and we confirm this to you on a durable medium; without that consent the standard 14-day right applies. For a service withdrawn while it is still being performed, you pay only for the proportion supplied up to that point.

10. Enterprise & white-label

Our enterprise/white-label offering (custom-branded apps, distribution, and any commercial-resale rights) is provided under separate agreements negotiated individually. Those agreements — not these Terms — govern that relationship and its commercial terms.

11. Marketplace

Marketplace terms version 2026-10-30.1

This section applies when you buy a plugin in the Marketplace, in addition to the rest of these Terms. If they conflict, this section prevails for Marketplace purchases. Creators who sell in the Marketplace also accept the creator agreement in §11.1.

We are the seller. You buy from us, PLUGINMAKER.AI sp. z o.o., not from the creator. We are the seller and merchant of record: we take your payment, charge and pay the VAT, handle refunds and deliver the plugin. The creator earns a share of the price from us.

Price and VAT. Prices in the Marketplace are shown without VAT. VAT is added at checkout according to your billing address, and you see the full amount before you pay. If you buy as a business and enter a valid EU or UK VAT number, VAT is reverse-charged where the law allows and is not added.

What you get. A licence to install and use the plugin in your own music production, personal or commercial, and to release and sell the music you make with it. The licence is personal to you, has no time limit and ends only as this section says. You get no source code and no ownership. You may not copy, share, redistribute, resell, sublicense or rent out the plugin, or take it apart, except where the law gives you that right. After payment the plugin is made available in your pluginmaker.ai account: you can install it from the pluginmaker.ai installer (sign in with the same account) and download it from your Library.

Right of withdrawal. If you are a consumer, you normally have 14 days to withdraw from a purchase. A plugin is digital content that we make available immediately, so before you pay you must tick this box at checkout. The box shows this statement in English, with a Polish translation under it; both have the same meaning.

I agree that pluginmaker.ai makes this plugin available to me immediately after payment, and I understand that I lose my 14-day right of withdrawal once it has been made available.

Once you have ticked it and the plugin has been made available to you, you lose the 14-day right of withdrawal. After payment we email you a confirmation of your purchase and of this consent: it names the plugin and the amount you paid and repeats the exact line you ticked. Your statutory rights if a plugin is faulty or not as described (§13) are not affected.

Refunds. A refund ends your licence: we remove your access to the plugin, and you must stop using it and delete your copies. We refund a purchase when you withdraw in time, when you are entitled to a refund because the plugin is faulty or not as described, and when we remove a plugin as described under Takedown below. Any further refund is at our discretion; write to office@pluginmaker.ai. A refund goes back to the payment method you used. If your bank reverses a payment, your access to that plugin ends too.

No buying your own plugin. You cannot buy a plugin you listed yourself. We block such purchases and may cancel any that get through.

Takedown. We may remove a listing and end access to a plugin when the law requires it, when a rights holder makes a justified complaint (see §20), or when the plugin turns out to be unsafe or unlawful. If we do, we refund the price you paid, including VAT. If a plugin is only taken off sale, you keep your licence and your access to it in your account (in the installer and in your Library).

Support. For questions, problems or complaints about a purchase, write to office@pluginmaker.ai (complaints: §16). That an independent creator made the plugin does not change our responsibility as the seller (§13).

11.1 Marketplace creator agreement

Separate acceptance version: 2026-11-04.1.

1. Scope

This agreement is between you (the “Creator”) and PLUGINMAKER.AI sp. z o.o. (“we”). It applies when you accept it separately in order to list a plugin in the pluginmaker.ai Marketplace. Creating an account or accepting the general Terms does not accept it. Listing in the Marketplace is available to Pro subscribers.

This is the separate agreement that §6.3 of the Terms asks for: a plugin you generated may be sold only through the Marketplace under this agreement, or as the Pro addendum (§10.1) or an enterprise agreement provides. The Terms, including §§6, 18 and 20, still apply to your account and your plugins.

Marketplace sales are governed by this agreement alone. The 25% revenue share, reports and invoices of the Pro addendum do not apply to them, and nothing is charged twice.

We record the version you accept, when you accept it and from which account. The agreement is available in English and Polish; you accept the language shown, and if the two differ, the one you accepted prevails.

2. Your plugin and our licence

You keep the rights you have in your plugin: your prompts, samples, designs and creative choices. Our runtime library, templates and other platform software inside the plugin stay ours (Terms §6.2). By listing the plugin you agree that we license them to buyers as part of it.

You give us a non-exclusive, worldwide licence, with the right to sublicense buyers, to host, reproduce, display, promote, sell and deliver copies of the plugin, including a Sampler's sample library, and its listing (name, description, images, audio previews), and to license buyers to use it under the buyer terms. It lasts while the plugin is listed, and afterwards for as long as we need it to serve buyers who already bought, to give support and to keep accounting and legal records. It is a licence, not a transfer of ownership.

3. Selling, price and VAT

We are the seller and merchant of record. We take the buyer’s payment, charge and pay the VAT, handle refunds under the buyer terms and the law, and deliver the plugin. You set the price of your plugin, excluding VAT. A new price applies to later sales only.

Buyers get a licence to use your plugin in their own music production. They get no source code and may not share or resell it.

4. Your share and payouts

For every sale you receive 75% of the price excluding VAT and we keep 25%. We bear the Stripe payment fees; they do not reduce your share. Your share is the payment for the licence you give us.

We pay out once a month. At the start of each month we pay your share of all sales in the previous calendar month to your Stripe account. We pay any amount that is due; there is no minimum payout. To be paid, you must complete Stripe onboarding and give us the tax details we ask for. Until then we may hold your payouts. Held amounts stay yours and are paid once you complete onboarding; until then they may be used to cover refunds and chargebacks (section 5).

5. Refunds and chargebacks

If a sale is refunded, or the buyer’s bank reverses the payment, your share of that sale comes back to us. If it has not been paid out yet, we do not pay it. If it has, we deduct it from your next payout. If there is no next payout, or it is too small, we recover the share by reversing the transfer to your Stripe account, or you repay it on request.

We decide whether to refund a buyer under the buyer terms and the law, including the 14-day withdrawal right of consumers. A refund removes the buyer’s access to your plugin.

6. Your promises

You promise that: (a) the plugin and everything in it (samples, code, presets, images, names, trademarks) is yours, or you have the right to license it for sale here, and it contains no third-party material without that right; (b) the plugin contains no malware or hidden functions, and makes no network calls and collects no data of its own beyond what the pluginmaker.ai runtime does; (c) your listing is accurate and not misleading; and (d) the plugin and listing break no law and no one’s rights.

If a third party makes a justified claim that your plugin infringes its rights because you lacked the rights, you cover our reasonable costs of dealing with the claim, including damages or a settlement we have to pay, provided we told you about the claim and agreed with you any settlement that affects you. You do not cover loss caused by our own breach.

7. Review, delisting and takedown

We may review a listing and reject it, and we may delist or remove a listing at any time, for example if it breaks this agreement, the Terms or the law, is unsafe, or misleads buyers. We tell you why and how to contest the decision: reply to our email within 14 days, and we restore the listing if we got it wrong.

Rights complaints about your plugin (https://pluginmaker.ai/report-content or office@pluginmaker.ai) and orders from courts or authorities are handled by a person. If a complaint holds up, we remove the listing, we may withdraw buyers’ access and refund them, and your share of those sales is taken back under section 5.

You can delist your plugin at any time. If you or we only delist a plugin, buyers who already bought it keep their licence and their access to it in their pluginmaker.ai account (in the installer and in their Library). Buyers lose access only after a refund, a reversed payment, or a takedown for unlawful content or a justified rights complaint.

8. Taxes

You are responsible for your own income taxes, social-security contributions and any other tax, invoice or receipt your law requires of you on your share. We provide a payout statement. We pay your share without deducting tax unless the law requires it, and we may report payouts to tax authorities where the law requires it. We charge and pay the VAT on sales to buyers.

9. Liability

We promise no sales. To the extent the law allows, we are not liable to you for lost sales, lost profit or indirect loss, and our total liability to you is limited to the shares paid and payable to you in the 12 months before the event. Nothing limits a liability that the law does not allow to be limited, including for intentional damage.

10. Changes and ending

You can end this agreement at any time by delisting all your plugins and telling us at office@pluginmaker.ai. We can end it with 30 days’ notice, or at once for serious or repeated breach, fraud, infringement, or if we cannot lawfully pay you. Ending does not affect shares you have already earned (less refunds and chargebacks) or buyers’ licences.

We may change this agreement for a valid reason, for example a change in law, tax, payment rules or the Marketplace, by emailing you at least 30 days before the change applies. A change does not affect sales made before it applies. If you disagree, you can delist your plugins and end the agreement before it applies.

11. Law and contact

Polish law governs this agreement. If you are not a consumer, the courts of Poznań, Poland have exclusive jurisdiction. If you are a consumer, §15 of the Terms applies instead, and nothing in this agreement limits your mandatory rights.

Contact and notices: office@pluginmaker.ai.

12. Telemetry & privacy

Our installer and plugins may collect crash and diagnostic telemetry, and web analytics are governed by our cookie settings. How this data is collected and how you can control it is described in our Privacy Policy.

13. Statutory rights & warranties

If you are a consumer, you have statutory rights regarding the conformity of paid digital content and services that we cannot exclude or limit. Nothing in these Terms (including §2) affects those rights. Subject to that, the service is otherwise provided "as is".

14. Liability

Nothing limits our liability for fraud or for anything that cannot be excluded or limited under applicable law (including mandatory consumer protections). Subject to that, our aggregate liability arising from the service is limited to the amount you paid us in the 12 months before the claim, and we are not liable for indirect or consequential loss (such as lost profits or data loss).

15. Governing law & disputes

These Terms are governed by the law of Poland. If you are a consumer, this choice does not deprive you of the mandatory protections of the law of your country of habitual residence, and you may bring proceedings in the courts of your home country. Consumers may also use the out-of-court dispute resolution procedures available in their country and, in Poland, seek assistance from consumer authorities (UOKiK or the municipal consumer ombudsman).

16. Complaints

You can raise a complaint (reklamacja) at office@pluginmaker.ai. We will acknowledge and respond within 14 days.

17. Changes & termination

We may update these Terms; material changes require your acceptance (§3). We may suspend or terminate accounts that violate these Terms. You may have your account deleted at any time, on request by email to office@pluginmaker.ai. On deletion, your generated plugins and account data are removed in line with our Privacy Policy; we may retain limited records where required (e.g. tax and accounting).

18. Your samples

You can upload your own audio to build Sampler plugins. You keep ownership of everything you upload.

Only upload audio you own or have a licence to use this way. Many sample packs forbid putting their sounds in an instrument others can play, so check the licence first. Don't upload anything unlawful. By uploading, you confirm this. If someone claims that samples you uploaded infringe their rights, you'll cover our reasonable costs of dealing with that claim, including any damages or settlement we have to pay because of it.

You give us a worldwide, non-exclusive, free licence to store, process and encrypt your samples, to build them into your plugins, to test and quality-check those plugins, and to deliver them to you. Testing includes automated test runs on our own infrastructure and on our service providers' machines, such as automated test runners. Our hosting and service providers may do this for us. If you list a Sampler in the Marketplace under the creator agreement (§11.1), that licence also covers delivering its samples to your buyers. We use your samples for nothing else. The licence ends once we delete them (see below), except for copies already delivered.

Except for delivery to your buyers under §11.1, your samples are private to your account. Authorised pluginmaker.ai staff may access them only for support, safety or legal reasons. Selling or distributing a Sampler instrument is only possible through the Marketplace under §11.1, under an enterprise agreement with us, and not otherwise.

Each file can be up to 64 MiB. Total storage is 1 GB on Free and 25 GB on any paid plan.

A sample you remove stays while an earlier version of your plugin still uses it, so you can go back. When you delete a plugin or we delete your account, we delete their samples within 30 days. Backups follow on their normal cycle. Copies already downloaded stay where they are.

We may remove samples, or disable plugins that contain them, if they infringe rights, are unlawful or break these Terms. We'll tell you why and how to challenge that.

19. No-training promise

We promise we won't train any AI model on the samples you upload.

20. Reporting content

To report user content on pluginmaker.ai that infringes your rights or is illegal, use our report form or email office@pluginmaker.ai with:

  • your name and email address;
  • the exact link;
  • why it's illegal (for copyright: which work is yours, and how it's used);
  • a statement that you believe in good faith that the notice is accurate and complete.

A person reviews every notice; nothing is decided automatically. We confirm receipt of a notice straight away when it comes through the report form, and without undue delay when it comes by email. We act on complete, valid notices within 5 business days (the clock starts once a notice is complete). Court or authority orders, and content that endangers life or safety or involves child sexual abuse, are handled immediately. If a notice holds up, we disable the samples and the affected plugin versions. That stops new downloads, but it can't remove copies already installed. We tell you our decision and how to challenge it.

If we remove your content, we email you what we removed, why, and how to contest it. To contest, reply within 14 days and say why the content is lawful, for example by sending your licence. We may share your reply with the reporter. If we got it wrong, we restore the content. For a copyright notice, unless the reporter tells us they have gone to court, we restore the content between the 10th and 14th business day after your reply. You can always go to court.

Repeat infringers lose their account: we terminate any account that repeatedly uploads infringing samples (3 valid notices). We may ignore people who keep sending clearly unfounded notices.

Our DSA point of contact for users and authorities is office@pluginmaker.ai, in English or Polish.

Our designated DMCA agent (17 U.S.C. §512) is the Copyright Agent, PLUGINMAKER.AI sp. z o.o., Os. Piastowskie 94/26, 61-162 Poznań, Poland, office@pluginmaker.ai. US notices also need your signature and a statement, under penalty of perjury, that you may act for the rights holder.
